Applicant Testing

  • No restriction on applicant testing in the private sector
  • Local governments and state colleges may conduct test pursuant to a written policy and with advance notice
  • Grounds for not hiring: positive results, refusal to test

Employee Testing

  • Employer's written policy must be distributed to all employees
  • Authorized testing: post-accident investigations, reasonable suspicion, preannounced periodic testing, random testing in safety-sensitive positions, federal law requirement, possible employee impairment
  • Positive result and refusal are subject to referral for rehabilitation, discipline or discharge

Conditions & Methods

  • Documentation showing chain of custody from time of collection
  • Confirming test in case of positive result
