Applicant Testing

Applicant testing authorized, pursuant to employer's written policy and with advance notification of applicant, only after an offer of employment has been made and only if all candidates for the job are tested

Employee Testing

  • Authorized testing: after an accident, as part of an employee assistance program, annual physical exam (provided employee has two weeks advance notice), or reasonable suspicion
  • Random authorized testing in safety-sensitive jobs
  • Positive result (pending outcome of confirming test) may lead to suspension or transfer
  • Refusal or failure to complete treatment may lead to discharge
